The Marks Gray Immigration Team regularly helps employers who qualify for cap-exempt H-1B visas. This month, we are highlighting the success story of a college and a mathematics professor from Ethiopia.
The H-1B allows US employers to employ foreign workers in specialty occupations. Certain organizations are exempt from the highly competitive annual H-1B visa lottery, including institutions of higher education, non-profit entities related to or affiliated with a higher education institution, and nonprofit or government research organizations.
If an organization qualifies for a cap exemption, they are not limited to filing their H-1B petitions in April; they can do so any time they have a qualified candidate.
We prepared a strong H-1B petition for our client, a college, highlighting the professor/candidate’s advanced degrees and over fifteen years of progressive teaching experience. The petition also included strong evidence that the state college seeking to employ the professor qualified for the H-1B cap exemption as an institution of higher learning.
Our documentation, up-to-date knowledge of USCIS’ requirements, and thorough preparation led to a great result: this cap-exempt H-1B was approved! As a result, our employer client was able to hire and retain a very experienced and exceptional professor on their staff.
